corrupt is when i support an elected official who believes in the second amendment that right to bear arms, then by your very own definition your boss, chicago mayor rahm emanuel must also be corrupt since he receives donations from the big wigs in hollywood and the moosic industry. the same industry that sells blood soaked violence movie, video games to our kids. hell, they even warn the president to stay away from their industry. so let me see. if i understand this. if i support a politician who believes in the second amendment i'm corrupt but if your boss as a politician receives donations from those who believe in an uncensored first amendment he is not corrupt. and racist? you say our federal gun laws are racist? are you really a cop? i'll tell you what racist is.

not policing a 12 block area on the south side of chicago where children are shot so often they don't even run when they hear gunfire. i will tell you what's racist. making sure the loop in downtown chicago where i, by the way, lived for three years, sees virtually no homicides. yet on the south side of town the poor, the downtrodden, defenseless black and brown children are murdered in the middle of the day, in parks, on playgrounds and in places where they have a right to be. i'll it tell you you what's racist. expending all your resources when nato comes to town and the world is watching. when every sunrise on the minority side of town virtually guarantees certain death to a minority. and with a 75% chance that no one will ever be held

accountable. let alone arrested and convicted. you allow gangs with illegal weapons to patrol the streets on the south side of chicago putting innocent victims at risk. and you hide behind accusations of racism while people in your city are dying. you criticize my right to own a legal gun that you want to tax and trace while your city is trampled by people with illegal guns. why don't you track and trace them? you want to talk about federal gun laws? wasn't your boss rahm emanuel chief of staff in the obama administration which oversaw the biggest illegal gun running operation in our nation's history? wasn't he the chief of staff as the obama administration sent assault weapons to mexico to the drug cartels which were then used to kill american border agents? and if you are such a genius,

why is the murder rate in chicago higher now than when you got to town? and if 42 people were killed in january in the middle of the winter, what is going to happen this summer? and speaking of numbers, here is a doozy you guys are are so corrupt you won't even release statistics on your own city's criminal justice numbers. try as we might, six people, six people gave us the runaround this week from the state's attorney's office and the clerk's office saying you don't keep statistics on murder arrests and gun crimes. i'll bet you don't. hell, it would only make you look like the hypocrit that you are. but it is not just me. even the chicago justice project can't get this information from you. we have no idea how many of the arrests for murders actually

result in convictions because the political will to collect this data has been lacking within the cook county states attorney's office. those are their words. no surprise there. but how dare you pontificate from your perch in the undisputed murder capital of america and mali it gn legal gun other thans as agents of the political corruption when you can't even control the flow of illegal guns in the city you are charged with protecting. and you want us to buy liability insurance? why don't you just focus on solving your own problems? i have been a prosecutor, a judge and an elected d.a. let me give you a few tips. get yourself some confidential informants, undercover officers, search warrants, surveillance, wiretaps, probable cause and start making some arrests and make sure that

your cops charge those crimes which require mandatory incarceration and make sure that the states attorney's office prosecutes those arrests and the judges follow the law and send them to jail. now, do you want to redefine your definition of corrupt? you know, my mom always told me better to remain silent and thought a fool than open your mouth and remove all doubt. didn't your mother ever tell you that? joining me now is south carolina man jeff duncan and steven halbrook. congressman duncan you have been in politics for awhile. you have gotten high ratings from the nra. does that make you corrupt? >> no. makes me a believer in the second amendment, the right of the people to keep and bear arms. i think these guys like the police chief in chicago and the

governor in new york and even the vice president need to go back and have a history lesson and learn what our founding fathers said about the second amendment and why they put that in the bill of rights. >> judge jeanine: you wrote a book that i referred to many times on the second amendment. this whole idea of saying that we need to have liability insurance, a million dollars if we are going to get a licensed gun, i mean does that strike you as constitutional? >> well, talk about being prejudice against poor people and minority groups. who can afford this kind of insurance? first of all, it won't be he available. the insurance industry does not insurance against criminal violence. the black codes that he referenced disarmed african american citizens. it was only when the 14th amendment was adopted after the civil war that these black codes were done away with and now he wants to impose

restrictions that are far are more onerous than toll taxes ever were. the kind of insurance you are talking about besides not being available, it is incredible to think about what it would cost. >> judge jeanine: they say we looked into it, it is $1,600 to $2,000 a year. this guy really believes, congressman, that we should take a public opinion poll and the judges should refer to the public before they make decisions interpreting the constitution. is this guy out of his mind? >> absolutely he is out of his mind. this is an infring infringemenr second amendment rights. we need conversation about mental health and safe schools and how we protect our children and prosecute the crimes where a firearm is used why we don't take that to the letter of the law. there are lot of other curves we could have in this -- conversations we could have in this country. that is way out of bounds.

sheriff clark. this is the same guy leading the task force. he says go out and shoot your gun in the air. >> it is amazing. this guy never ceases to amaze me. not the first time that he left americans scratching their heads in bewilderment. a shotgun is a great home defense item. you don't go out and shoot it up in the air. i go back to the addage when seconds count police are just minutes away. she needs to be trained on how to use the shotgun inside the house in case an intruder comes, not going out and shooting up in there. >> judge jeanine: sheriff clark, i can think of negligent homicide charges being brought against someone because you shoot a gun in the air and when it comes down and kills someone, which has happened, clearly it is a criminal charge. >> you know, with all due respect to vice president biden he is wrong on a number of counts. one is as you mentioned recklessly endangering safety.

firing a gun out a window might be effective for killing a streetlight and that is about it. he needs to think about these things before he just throws these things out like that. he is making a bad situation worse when gives that kind of advice. what i try to do is tell people i will give you information. you have to make those decisions in your situation. first of all, train and educate yourself in the use of that weapon before you have to use it. second -- >> judge jeanine: let me ask you this, sheriff. if he is saying buy a shotgun, you shot a shotgun in the air and he is saying it is easier than an ar-15 with a shotgun you have a bigger reach with the bullet, not a bullet. >> the shell, the casing. >> the casing. >> the bullet. the load that comes out of it. he is patently wrong on that, too. i fired the version of the ar-15. we use a smith and wesson

street and saw a shotgun i would think they were shooting at me and if i'm armed i'm going to return fire. >> judge jeanine: you are going to shoot back. >> exactly. >> judge jeanine: congressman, you know that this administration is trying hard to limit gun right in this country and in fact there is an effort by i think the colorado legislature to limit magazine capacity as they have done in new york. you want those businesses to come to south carolina. >> absolutely. we are freedom loving state. and we would love to have remington arm and magglio pool themaker of the high capacity magazines but the cosmetic features that the president and dianne feinstein have used to classify something an assault weapon are made by magglio pool. if they decide to leave colorado which they said they will do if they go forward with the legislation we would love to have them here in south carolina. a great work environment and business climate and i know governor haley will reach out and say come on in to south carolina you will like this

the thought is prepostorrous. >> judge jeanine: the thought is and people are concerned about it. the whole idea of identifying gun owners in newspapers and chipping away at the gun rights and getting a ridgetry. this guy mccarthy the chief of the third largest police department in the nation who works for rahm emanuel who is so connected to the white house saying we should be able to put a chip in your gun. are you crazy? >> if the united states, the white house or anybody would turn over the name of gun owners in the united states to a foreign nation that would be an act of betrayal on the american people. if the mexican deserves anything, it is more facts surrounding fast and furious. guns being used to kill mexican citizens. they should be demanding more answer about that. >> judge jeanine: they should be angry with this administration for sending the guns in and not telling them

about it because their people were murdered as well. let me go to you, steven. you are the constitutional expert here. in mexico, lawmakers are actually considering asking the united states to provide a registry of all gun owners in the border states. california, new mexico, arizona, and texas. their reasoning is claiming that it will make tracing guns used in violent crimes easier. talk to me. >> registration is prohibited by u.s. law. it has been for a long time. our first law prohibiting registration was passed before world war ii. registration means confiscation. the owner's protection act signed by president regan prohibits registration. the background check system prohibits it. we don't want a system in the country where the name and identities are given to the government and can you imagine

turning this over to the mexicans? you have members of the mexican police and military selling their guns to gun traffickers. what are they going to do next, organize burglary rings to go into the united states? >> here is where the guns are, go get them. >> yes. >> judge jeanine: sheriff, let me to back to you. merc carthy. you have 25 years. a homicide detective. elected three times as sheriff. you have been around the block. you know the drill. why would the police chief, he can't combat murders in chicago. he is not succeeding. what is your message to him? >> he doesn't have any answers for all of the killing that is going on in chicago right now and when you don't have answers you deflect. he chose to blame law abiding gun owners for the carnage and bloodshed going on in chicago. he needs to spend more time attacking criminal gang members instead of law abiding gun owners. he needs to get his arms around this thing.

not see that she is not in the bed? and if you are so scared that you didn't notice that she was not on her side bed, how did you ever find your gun, a slot smaller and harder to find than she is? and if you are so scared about criminals breaking in, why weren't there locks on the bathroom window. and by the way, if you were so scared, why even open the sliding glass door to bring in the fan? okay. if it really was a burglar, why would he climb up a ladder and crawl through the bathroom window when simply could have walked through your unlocked sliding glass door? and if it really was a burglar did he forget to teak a leak before he broke in and was he so shy and embarrassed you might see him with his pants down he didn't just close the bathroom door but he actually locked it? so much for my thoughts on pistorius. joining me via skype from south

africa is adam wakefield. thanks for being with us this evening. tell us what the latest is there. >> yes, judge. the latest is that as everybody i think around the world found out pistorius is now out on bill. he is staying at an undisclosed location. reports have him staying at his uncle arnold's residence. he supposedly wants to get in contact with the steenkamp family who is in mourning. the family said the only one that actually knows what happened is oscar. now, he waits for the next appearance in court to see where the drama takes us next. >> judge jeanine: adam, how unusual is it for someone charged with premeditated murder to be released on bail in south africa? >> it is quite unusual. it is pretty much the most serious offense you can be

charged with is since we don't have the death penalty. for a schedule is six offense to be granted bail the burden of the proof lies upon the defense to prove exceptional circumstances so that the african can be given bail. there is murder and then it is easier to get bail. the fact that he was granted bail was surprising and unusual but given how it has proceeded in court it wasn't unwarranted. >> judge jeanine: last question. in researching what the issue of domestic violence in south africa the reports are not very good there and, of course, there are reports that both the defendant and reeva the victim in this case had been arguing for about an hour. and the police there have been accused of a lack of understanding of or interest in the domestic violence act which -- and they highlighted the minister and police lack of will to prosecute these cases. is that an honest assessment of what is going on in south

africa? >> i think you -- you said it earlier, the will of justice -- the wheels of justice turn quite slowly steenkamp one of many women affected by domestic violence. it as very large problem. it happens far too often. violent crime happens very often. and as i think the world saw you during the arguments during the bail hearing the police -- it is a problem and even the president addressed it. >> judge jeanine: thanks so much for being with us this evening. and joining me now on the phone from south africa is the editor for the heap, whose south african magazine got an exclusive interview with reeva steenkamp just a week before her death. good evening. >> how are you, judge? >> judge jeanine: very well,

thank you. all right, we know that you were able to get the last print interview with reeva before she was murdered. can you tell us what -- what her state of mind was? and how she talked about oscar pistorius? >> of course. you know what is thought of judge is obviously nobody could have predicted what could happen this past week and what we got during that last interview was a woman that was purely in love and that was just like thrilled to be in this relationship with this man and the thing that i keep on saying is that you know celebrity couples as soon as a celebrity couple gets together and start doing a lot of media it means that they are are publicity hungry. however, with these two they would kind of keep out of sight because they were trying to keep it private because they wanted to really work on their relationship which means it was quite serious. this all came as a huge is

surprise. >> judge jeanine: how long had they been together? >> since october of last year. definitely a new relationship. we as the magazine had known about it and it was one of those situations in south africa where we knew they were seeing each other but they were keeping it under the radar because they wanted to wait until things were very, very serious. it definitely showed signs of people who were in love and were in a serious relationship. >> judge jeanine: andre, was he known as a hot head? >> judge, to be honest with you, there have been reports in the past of that. of situations related to him being a hot head. getting angry. drunken outbursts and stuff like that. but you know -- >> judge jeanine: wasn't there even a discharge of his gun in a restaurant and threats of breaking someone's legs and also i think there was in

addition to that a problem in -- with another -- with an ex-girlfriend? >> there was. there was an incident recently at a restaurant where a gun got discharged and lucky it didn't hit anybody. all of those things were kind of -- we know how the media works it gets covered up and people don't want to speak about it and things kind of disappear. there have been reports. can i please also say that i have met oscar many, many times in my life and during my career and he has always been a genuinely humble lovely person to hang around. to be honest with you when all of this stuff happened we were completely, completely shocked despite the hot headed reports from the past. >> judge jeanine: all right, andre. everybody has more than one side. >> absolutely. >> judge jeanine: thank you for being with us this evening. and coming up the justice experts on the oscar pistorius

acquittal rate. >> he had to lock himself into a story which is not something a defense wants to do but the is story is ludicrous and makes no sense how he would shoot into a bathroom door when his girl friend is in the apartment. a strong case but undermined by the income pa tense of law enforcement. they assigned a prosecutor who had 7 counts. >> judge jeanine: that was in 2011. >> but judge, judge. >> judge jeanine: let me finish. this guy pistorius comes out on the scene and they filed the charges again. that is baloney. >> he is accused of being intoxicated and open oing fire on a mini bus full of people. wouldn't you at least not have him assigned to -- >> he is only being accused. >> you don't have the -- >> judge jeanine: i'm on his side. how is it that you say we are not going to charge you a year later and then pistorius comes along and they take the detective's credibility away?
